These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”, “your”) and BookmyDOC HEALTHTECH PRIVATE LIMITED (“BookmyDOC”, “Company”, “Platform”), governing your access to and use of the Zyro Care mobile application and website (collectively referred to as the “Platform”).
Zyro Care operates as a technology platform designed to build a digital bridge between hospitals and users by facilitating access to healthcare-related services through the Platform.
By accessing, registering on, or using the Platform in any manner, you acknowledge that you have read, understood and agree to be bound by the Terms and Conditions herein, along with any applicable policies referenced herein, including but not limited to the Privacy Policy.
Zyro Care reserves the right to modify, update, or revise these Terms and Conditions at its sole discretion. Any such changes shall become effective upon publication on the Platform. Continued use of the Platform following such updates constitutes your acceptance of the revised Terms.
Your access to and use of the Platform is subject to compliance with these Terms and all applicable laws and regulations.
Zyro Care operates as a digital healthcare technology platform that facilitates interactions between Users and healthcare providers. The Services offered through the platform include, but are not limited to:
Zyro Care is a technology platform, functioning as intermediary and does not provide medical services. The Company's role is limited to enabling Users to connect with independent healthcare providers, including hospitals, clinics, doctors, pharmacies, and diagnostic centers. Zyro Care does not practice medicine, provide diagnoses, or deliver treatment.
Healthcare providers made available through Zyro Care, including doctors, hospitals, clinics, pharmacies, and diagnostic centers. Any collaboration, partnership, or association between Zyro Care and such healthcare providers shall not be construed as creating an employer-employee relationship, agency relationship, or joint venture.
Zyro Care does not control, supervise, or influence:
All healthcare services are rendered directly by the respective providers, who remain solely responsible for their services.
Zyro Care may facilitate prescription-based medicine orders through licensed pharmacies or authorized sellers. Zyro Care is not the seller, distributor, or manufacturer of medicines. The Company assumes no responsibility for:
All obligations relating to medicines rest solely with the respective pharmacy or seller.
Zyro Care does not warrant or guarantee:
Healthcare outcomes depend on multiple factors beyond the Company's control.
Zyro Care is not intended for booking appointments for medical emergencies or life-threatening situations.
Zyro Care is not liable for the medical services, treatments or diagnosis by the medical providers.
Zyro Care is not liable for Medical Negligence claims.
This section governs the eligibility criteria, account creation requirements, and responsibilities associated with User accounts on the Zyro Care platform. Access to certain Services may require registration, identity verification, and compliance with platform security protocols. By creating an account, Users agree to comply with these Terms and all applicable laws.
To access and use the Services offered through Zyro Care, a User must be at least eighteen (18) years of age. By registering on the platform, the User represents and warrants that they possess the legal capacity to enter into a binding agreement under applicable law.
Individuals below eighteen (18) years of age (“Minors”) may use the platform only under the supervision and consent of a parent or legal guardian. The parent or legal guardian shall be solely responsible for:

Access to certain Services requires Users to create an account with Zyro Care. Users agree to provide accurate, current, and complete information during registration and to update such information as necessary. Zyro Care reserves the right to deny, restrict, or refuse account creation at its sole discretion.
Users are solely responsible for ensuring that all information submitted on the platform is true, accurate, current, and complete. Zyro Care shall not be responsible for any consequences resulting from inaccurate, incomplete, or misleading information provided by Users.
Users are responsible for maintaining the confidentiality of their login credentials, including passwords, OTPs, and authentication details. All activities conducted through a User's account shall be deemed authorized by the User. Users must immediately notify Zyro Care of any unauthorized access or suspected security breach.
Users are permitted to maintain only one (1) active account on Zyro Care. Creation or operation of multiple accounts by the same User, whether directly or indirectly, is strictly prohibited. Zyro Care reserves the right to suspend, merge, or terminate duplicate accounts at its sole discretion without prior notice.
Zyro Care reserves the right, at its sole discretion, to suspend, restrict, or terminate a User account without prior notice, including but not limited to cases involving:
Users acknowledge that such actions may result in loss of access to platform features and data.
Users are solely responsible for all activities conducted through their accounts. Zyro Care shall not be liable for losses arising from unauthorized account usage resulting from User negligence, failure to maintain credential security, or misuse of the platform.
This section outlines the responsibilities, obligations, and acceptable usage standards applicable to all Users accessing or using the Zyro Care platform.
Users agree to access and use Zyro Care strictly in compliance with applicable laws and regulations. Users shall not use the platform for any unlawful, fraudulent, abusive, or malicious activities.

Zyro Care reserves the right to take appropriate action in cases of misuse.
Users are solely responsible for the accuracy and legitimacy of personal information, medical details, and uploaded documents (prescriptions, records, etc.). Zyro Care shall not be liable for errors arising from inaccurate User data.
Users shall not attempt to reverse engineer the platform, hack, manipulate, or disrupt systems, introduce malicious software, or interfere with platform operations. Any such actions may result in immediate account suspension and legal action.
Users agree to maintain respectful and lawful communication with healthcare providers and other Users. Harassment, abusive language, threats, or inappropriate conduct may result in account suspension.
Users agree to fulfill all payment obligations associated with Services availed through the platform. Failure to complete payments may result in restriction of Services.
Users shall be solely responsible for any losses, damages, or legal consequences arising from violations of these Terms. Users agree to indemnify and hold Zyro Care harmless from claims arising due to misuse or unlawful conduct.
This section governs payments, applicable charges, and refund conditions related to Services offered through the Zyro Care platform.
Zyro Care may facilitate payments for Services offered through the platform, including but not limited to appointment bookings, consultations, and other healthcare-related services. Payments may be processed through third-party payment gateways integrated with the platform. Zyro Care does not store Users' sensitive financial information such as card details, banking credentials, or payment authentication data.
Users agree to provide valid and accurate payment information. Users are solely responsible for ensuring successful completion of payments. Zyro Care shall not be liable for payment failures arising from:
Users acknowledge that pricing for Services may be determined by healthcare providers, including doctors, hospitals, pharmacies, or diagnostic centers. Zyro Care reserves the right to levy platform service fees, convenience fees, or transaction charges, which shall be displayed where applicable. All applicable taxes, including GST, shall be charged in accordance with prevailing laws.
Users may cancel appointments or Services subject to applicable cancellation rules. Cancellation eligibility may depend on timing of cancellation, provider policies, and nature of Service. Zyro Care reserves the right to apply cancellation charges where applicable.
Refunds shall be considered only in valid circumstances, including but not limited to:
Refund requests shall be processed in accordance with Company policies and applicable payment gateway procedures. Zyro Care reserves the right to approve or reject refund requests at its sole discretion.
Users acknowledge that failure to attend scheduled appointments or consultations (“No-Show”) may result in forfeiture of payments, no refund eligibility, and applicable penalties. This policy is intended to prevent misuse and protect healthcare providers.
Payments processed through third-party payment gateways shall be governed by the respective payment provider's terms and policies. Zyro Care shall not be liable for payment gateway failures, banking delays, or transaction processing errors.
Approved refunds shall be processed within reasonable timelines, subject to payment gateway procedures, banking channels, and third-party processing delays. Zyro Care shall not be responsible for delays caused by external financial institutions.
This section governs the ownership and permitted use of the Zyro Care platform, including its technology, content, and branding.
All rights, title, and interest in and to the Zyro Care platform, including but not limited to software, design, layout, user interface, features, content, logos, trademarks, and technology, shall remain the exclusive property of Zyro Care HEALTHTECH PRIVATE LIMITED.
The Platform and its components are protected under applicable intellectual property laws. Users shall not copy, modify, distribute, reproduce, reverse engineer, decompile, or republish any part of the Platform without prior written consent from Zyro Care.
The name Zyro Care, logos, branding elements, and associated identifiers are proprietary assets of the Company. Unauthorized use, reproduction, or imitation of Company branding is strictly prohibited.
Zyro Care grants Users a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for personal and lawful purposes. This license does not grant Users any ownership rights in the Platform.
Users shall not attempt to extract platform data, scrape system information, use automated bots, interfere with platform operations, or exploit platform vulnerabilities. Any such actions may result in account suspension and legal action.
Any third-party content, trademarks, or materials appearing on the Platform remain the property of their respective owners. Zyro Care does not claim ownership over third-party intellectual property.
Unauthorized use of Zyro Care's intellectual property may result in immediate suspension of Services, legal proceedings, and claims for damages.
This section defines the extent of liability of Zyro Care arising from use of the Platform and Services.
The Services and the Platform are provided on an “as is” and “as available” basis. Zyro Care makes no representations or warranties of any kind, whether express or implied, regarding platform availability, accuracy of information, service reliability, or error-free operation.
Zyro Care shall not be responsible or liable for medical advice, diagnosis, treatment decisions, prescriptions, or healthcare outcomes. All medical services are provided exclusively by independent healthcare providers.
Zyro Care shall not be liable for acts, omissions, errors, or failures of third parties, including but not limited to doctors, hospitals, pharmacies, diagnostic centers, and payment gateways. Users acknowledge that third-party services are outside the Company's control.
Zyro Care shall not be liable for losses arising from system failures, network disruptions, platform downtime, software errors, or technical delays.
Zyro Care shall not be liable for payment failures, banking delays, incorrect transactions, or refund processing delays where payments involve third-party gateways.
To the fullest extent permitted by applicable law, Zyro Care shall not be liable for any indirect, incidental, consequential, or special damages, including loss of profits, loss of data, or loss of business opportunities.
To the fullest extent permitted by law, the total liability of Zyro Care arising from use of the Platform or Services shall not exceed the amount paid by the User for the specific Service giving rise to the claim. If no payment has been made, Zyro Care's liability shall not exceed INR 100 (Indian Rupees One Hundred Only).
Users expressly acknowledge that platform risks exist, healthcare outcomes vary, and technical failures may occur. Users agree to use the Platform at their own discretion and risk.
This section governs the User's obligation to protect Zyro Care from losses arising due to User actions or violations.
Users agree to indemnify, defend, and hold harmless Zyro Care HEALTHTECH PRIVATE LIMITED, its directors, officers, employees, affiliates, and partners from and against any claims, liabilities, damages, losses, costs, or expenses arising out of or related to:
Users agree to indemnify Zyro Care against any losses or claims arising from improper platform usage, fraudulent transactions, misrepresentation, disputes with healthcare providers, and unauthorized account activities.
In the event any third party brings a claim against Zyro Care arising from User actions, the User agrees to fully cooperate with the Company, bear all resulting liabilities, and reimburse legal costs where applicable.
The obligations under this section shall survive termination, suspension, or discontinuation of Services.
This indemnification obligation includes, but is not limited to, legal expenses, regulatory penalties (where caused by User actions), settlement costs, and damages awarded.
This section governs the collection, usage, storage, and handling of User information on the Zyro Care platform.
Zyro Care respects and is committed to protecting User privacy. Collection, storage, processing, and use of personal data shall be governed by the Company's Privacy Policy, which forms an integral part of these Terms.
Users acknowledge that Zyro Care may collect certain information necessary for providing Services, including personal information, contact details, health-related information, transactional data, and device and usage data. Such information shall be handled in accordance with applicable laws.
By using the Platform, Users provide consent for data collection, data processing, data storage, and data usage as required for Service delivery, platform functionality, security, and compliance purposes.
Users acknowledge that certain information shared on the Platform may constitute sensitive personal data, including health-related information. Zyro Care shall implement reasonable security safeguards; however, Users understand that no digital system is completely risk-free.
Users are solely responsible for ensuring accuracy of data submitted on the Platform. Zyro Care shall not be liable for consequences arising from incorrect or incomplete User data.
Zyro Care may share necessary data with third parties solely for Service facilitation, including healthcare providers, pharmacies, diagnostic centers, and payment gateways. Zyro Care shall not be responsible for third-party data handling practices.
While Zyro Care employs reasonable security measures, the Company does not warrant absolute security of data transmissions. Users acknowledge inherent risks associated with internet-based systems.
Users' data rights shall be governed by applicable laws and the Privacy Policy.
This section governs the availability, maintenance, and modification of the Zyro Care platform and Services.
Zyro Care strives to maintain continuous availability of the Platform and Services. However, the Company does not guarantee uninterrupted, error-free, or continuous access. Platform access may be affected by maintenance activities, system upgrades, technical disruptions, network failures, or events beyond Company control.
Zyro Care reserves the right to temporarily suspend or restrict Platform access without prior notice for maintenance, security concerns, technical issues, regulatory compliance, or operational improvements. Zyro Care shall not be liable for losses arising from such suspension.
Zyro Care reserves the right to modify platform features, update Services, add new functionalities, remove existing features, and change platform design at its sole discretion.
Users acknowledge that Zyro Care is under no obligation to maintain any specific feature or functionality indefinitely.
Users acknowledge that Platform performance may vary due to device compatibility, internet connectivity, software limitations, and third-party dependencies. Zyro Care shall not be responsible for such limitations.
Zyro Care may introduce beta or experimental features. Such features may be subject to instability, errors, or modifications. Users engage with such features at their own discretion.
Users acknowledge that digital platforms evolve continuously, and Services may change over time. Continued usage constitutes acceptance of such changes.
This section governs the conditions under which Zyro Care may suspend or terminate User access to the Platform and Services.
Zyro Care reserves the right, at its sole discretion, to suspend, restrict, or terminate User access to the Platform or Services at any time, with or without prior notice, in cases including but not limited to violation of these Terms, fraudulent or suspicious activities, misuse of platform Services, legal or regulatory requirements, and operational or security concerns.
Users may discontinue use of the Platform at any time. Termination of usage does not relieve Users of obligations incurred prior to discontinuation.
Upon suspension or termination, user access may be revoked, platform features may be disabled, pending transactions may be cancelled, and certain data access may be restricted. Zyro Care shall not be liable for consequences arising from termination.
Termination shall not affect payment obligations, liability clauses, indemnification obligations, or legal rights of the Company.
Zyro Care may retain or delete User data in accordance with applicable laws, regulatory requirements, Company policies, and the Privacy Policy.
Zyro Care shall not be liable for loss of access, loss of data, loss of benefits, or service disruptions arising from suspension or termination.
Relevant provisions of these Terms shall survive termination, including but not limited to liability limitations, indemnification, and governing law.
This section governs the legal framework applicable to these Terms and resolution of disputes.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles.
Subject to applicable dispute resolution provisions, the courts located in Narasaraopet, Andhra Pradesh, India, shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or use of the Platform.
Users agree to comply with all applicable laws, regulations, and statutory requirements while accessing or using the Platform.
Users accessing the Platform from outside India do so at their own initiative and are responsible for compliance with local laws.
This section governs the mechanism for resolving disputes arising from use of the Platform or these Terms.
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or use of the Platform (“Dispute”), the parties shall make reasonable efforts to resolve the matter amicably through mutual discussions.
If the Dispute cannot be resolved amicably within a reasonable period, such Dispute shall be referred to and finally resolved by arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996.
The arbitration shall be conducted by a sole arbitrator appointed by Zyro Care, in the English language, in Narasaraopet, Andhra Pradesh, India. The arbitral award shall be final and binding on the parties.
Users agree that arbitration shall be the exclusive mechanism for dispute resolution, subject to applicable law.
Each party shall bear its own costs unless otherwise determined by the arbitrator.
This section governs general legal provisions applicable to these Terms.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a competent authority, the remaining provisions shall remain valid and enforceable.
Failure by Zyro Care to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision.
These Terms, together with the Privacy Policy and other applicable policies, constitute the entire agreement between Users and Zyro Care regarding use of the Platform.
Users may not assign or transfer their rights or obligations under these Terms without prior written consent from Zyro Care. Zyro Care reserves the right to assign its rights and obligations.
Zyro Care shall not be liable for failure or delay in performance resulting from events beyond reasonable control, including but not limited to natural disasters, system failures, government actions, network disruptions, pandemics, and technical breakdowns.
Nothing contained in these Terms shall be deemed to create any partnership, agency, or employment relationship between Zyro Care and Users.
Provisions relating to liability, indemnification, dispute resolution, and intellectual property shall survive termination of Services.
